1. Introduction

These Terms and Conditions ("Terms") govern your use of Hope AI's online interfaces and properties, including the website, mobile application, voice chat agents, assessment tests, and services (collectively referred to as the "Services"). By using our Services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use our Services.

2. Eligibility

You must be at least 18 years old to use our Services. If you are under 18, you may only use the Services with the involvement and consent of a parent or legal guardian. Our AI assistants are programmed not to engage with users who identify themselves as being under 18 years of age.

3. Not a Substitute for Professional Medical Advice

Hope AI is an AI-powered mental health companion and is not a substitute for professional medical advice, diagnosis, or treatment. The content provided by our Services, including responses from our AI agents and results from mental health assessments, should not be construed as professional health advice. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

Our AI agents, including but not limited to Hope, Steve Jobs, Elon Musk, Mark Zuckerberg, and Ashneer Grover personalities, are designed to provide general information, support, and guidance only.

4. Emergency Services

Hope AI is not an emergency service. In case of a mental health emergency or if you're thinking about harming yourself or others, please call your local emergency number immediately. Our Services are not designed to address crisis situations and should not be relied upon in emergencies.

5. User Accounts

You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account. You must notify Hope AI immediately of any unauthorized use of your account or any other breach of security.

6. User Content

You retain ownership of any content you submit to our Services, including conversations with our AI agents and responses to assessment tests. However, by submitting content, you grant Hope AI a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your content in connection with providing and improving our Services.

You understand that all information you provide during your use of the Services, including during voice conversations with AI agents, may be used to train and improve our AI models, with appropriate privacy safeguards in place.

7. Prohibited Conduct

You agree not to:

• Use our Services for any illegal purpose or in violation of any local, state, national, or international law
• Harass, abuse, or harm another person
• Impersonate or misrepresent your affiliation with any person or entity
• Interfere with or disrupt our Services or servers or networks connected to our Services
• Attempt to gain unauthorized access to our Services or user accounts
• Use our Services to generate content that is harmful, abusive, racially or ethnically offensive, sexually explicit, or otherwise inappropriate
• Attempt to bypass or manipulate any usage limitations, including session time limits for voice chat agents
• Use automated methods or bots to access our Services
• Reverse engineer or decompile any part of our Services

8. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and share your personal information. By using our Services, you consent to our data practices as described in our Privacy Policy.

We take data security seriously. Information collected through our assessment tests and conversations with AI agents is stored securely and handled in accordance with applicable data protection laws. We implement appropriate technical and organizational measures to protect your personal data.

9. Intellectual Property

Our Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof) are owned by Hope AI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The AI personalities available through our Services, including their voices, response patterns, and knowledge bases, are proprietary to Hope AI or its licensors. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of our intellectual property without our express written permission.

10. Mental Health Assessment Tests

Hope AI offers various mental health assessment tests, including but not limited to depression, anxiety, burnout, and parenting style assessments. These tests are provided for informational and educational purposes only and are not diagnostic tools.

By using our assessment tests, you acknowledge and agree that:

• Test results are not a diagnosis and should not be interpreted as such
• The assessments are based on standardized screening tools but are adapted for a digital environment
• Results should be discussed with a qualified healthcare professional
• Your test responses and results may be stored to provide you with historical data and to improve our Services
• Anonymized and aggregated test data may be used for research and improvement of our Services

11. AI Voice Chat Agents

Hope AI provides AI voice chat agents, including but not limited to Hope (Mental Health Companion), Steve Jobs (Innovation Mentor), Elon Musk (Future Vision Strategist), Mark Zuckerberg (Tech Entrepreneurship Guide), and Ashneer Grover (Straight-Talking Business Mentor). By using these AI agents, you acknowledge and agree that:

• These are AI simulations and not actual representations of the individuals they are named after
• The information, advice, and guidance provided by these AI agents is generated by artificial intelligence and may not always be accurate or appropriate for your specific situation
• Voice conversations with AI agents may be recorded and analyzed to improve the quality of our Services
• You will not attempt to elicit harmful, illegal, or inappropriate responses from our AI agents
• Our AI agents are programmed with safety measures to decline engaging on certain sensitive topics
• Voice data may be processed by third-party services to enable the voice chat functionality

12. Usage Limitations

Hope AI provides free access to its Services with certain limitations:

• Voice chat sessions with AI agents are limited to 10 minutes of total free usage time per user
• We reserve the right to modify these usage limitations at any time
• Attempts to circumvent these limitations may result in termination of your access to our Services
• Additional usage beyond free limits may require payment or subscription in the future

We monitor usage patterns to ensure fair access to our Services for all users. Excessive or abusive usage may result in temporary or permanent restrictions.

13. Disclaimer of Warranties

Our Services are provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that our Services will be uninterrupted, timely, secure, or error-free, or that any content, including AI agent responses or assessment test results, will be accurate or reliable.

14. Limitation of Liability

Hope AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use, or alteration of your transmissions or content.

In no event shall our total liability to you for all claims exceed the amount you have paid to us (if any) for the use of our Services during the twelve (12) months preceding the event giving rise to the liability.

15. Indemnification

You agree to indemnify, defend, and hold harmless Hope AI and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from (i) your use of our Services; (ii) your violation of these Terms; (iii) your violation of any rights of another; or (iv) your conduct in connection with the Services.

16. Modifications to the Service

We reserve the right to modify, suspend, or discontinue, temporarily or permanently, the Services or any features or portions thereof without prior notice. This includes adding or removing AI agents, assessment tests, or other features. You agree that we will not be liable for any modification, suspension, or discontinuance of the Services or any part thereof.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in India.

18. Changes to Terms

We reserve the right to update or change our Terms at any time. The most current version will always be posted on this page with the effective date. Your continued use of the Service after we post any modifications to the Terms will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Terms.

We will make reasonable efforts to notify you of significant changes through a notice on our website or by email if you have provided one.
